§ 9-95. Criteria for issuing a precious metals dealer permit.

  • (a)

    Any person applying to the city for a license to conduct the business of a precious metal dealer shall also report to the police department and furnish their full name, address, physical description, age, North Carolina driver's license number (if applicable), and social security number (pursuant to G.S. 132-1.10(b) and (c)) to assist in an investigation of his criminal record and character. In addition, the applicant will be photographed and fingerprinted in order to facilitate the investigation.

    (b)

    If the applicant is a partnership or association, all persons owning or having an interest therein shall comply with the provisions of subsection above.

    (c)

    In the case of a corporate applicant, each stockholder owning ten (10) percent or more of the corporation's common stock shall comply with the provisions of this section.

    (d)

    Within five (5) days from receipt of notice by the administrator of denial of an application, or revocation or suspension of an existing permit, the applicant or permittee may appeal by submitting to the administrator a written request for a hearing before the city council. The council shall hear the appeal at its next regularly scheduled meeting in accordance with normal agenda procedures.

    (e)

    If the council finds that the applicant or permittee meets the requirements set forth in this article, it shall direct the administrator to issue or reinstate the permit. If the council finds that the administrator's decision should be upheld, then the revocation, suspension or denial shall become final.
