Chapter 10. MOTOR VEHICLES AND TRAFFIC |
Article VI-A. PUBLIC ASSEMBLIES AND PARADES |
§ 10-271. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Appeals official means the city manager, or his designee.
Applicant means the person applying for the parade permit.
Demonstration means a public display of sentiment for or against a person or cause, including protesting.
Festival means an outdoor concert, fair, community event, city-sponsored event, or similar event that is primarily commercial, governmental and/or recreational in nature.
Parade means an athletic event, march, ceremony, pageant, procession or other similar activity consisting of persons, animals, vehicles or things, or any combination thereof, that disrupts the normal flow of traffic upon any public street. The following are not parades:
(1)
A funeral precession supervised by a license mortuary;
(2)
A government agency acting within the scope of its duties;
(3)
Picketing authorized under section 10-280 et seq.; and
(4)
Student going to and from school classes or participating in school related activities provided such activities are under direct supervision of proper school authorities.
Parade permit means any written authorization required by this article.
Permit official means the person or persons designated by the city manager as being responsible for issuing permits under this article. The city manager may designate different persons as the permit official for different categories of permitted events and for different facilities or locations. Unless otherwise designated by the city manager, the chief of police shall act as the permit official.
Public assembly means:
(1)
A festival or demonstration which is reasonably anticipated to obstruct the normal flow of traffic upon any public street and that is collected together in one place; and
(2)
A festival in Veterans Park, Village Park, Bakers Creek Park, Safrit Park, CMC-Northeast Stadium or any other city-controlled park.
