§ 10-5. Towing vehicles.

  • Without limiting the authority conferred in section 10-232 of this chapter to remove vehicles, members of the police department are hereby authorized to direct the towing of vehicles in accordance with the procedures set forth in sections 10-236 under the following circumstances:

    (1)

    When any vehicle is upon any bridge, overpass or other elevated structure or within any tunnel or other underpass structure, where such vehicle constitutes an obstruction to traffic;

    (2)

    When a vehicle upon a street is so disabled as to constitute an obstruction to traffic and the person in charge of the vehicle is by reason of physical injury incapacitated to such an extent as to be unable to provide for its custody or removal;

    (3)

    When any vehicle is parked upon a street and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic;

    (4)

    When a vehicle is parked upon a street continuously for more than forty-eight (48) hours;

    (5)

    When the driver of a vehicle is taken into custody by a law enforcement officer and such vehicle would thereby be left unattended upon the street;

    (6)

    When any vehicle is parked on a street to be used for a procession, assemblage or parade;

    (7)

    When removal is necessary in the interest of public safety because of fire, flood, storm or other emergency.
