Not later than thirty (30) days after the filing of a completed application for a
merchant's license, the applicant shall be notified in writing by the city manager
or his designee of the decisions of the issuance or denial of the license. If the
merchant applicant complies with all application requirements and is found to have
no conformities, the applicant shall be issued a merchant's license. The city manager
may limit the number of licenses issued to a particular merchant or may limit the
total number of licenses outstanding at any given time to all merchants if such limitation(s)
promotes the health, safety or welfare of the city residents or otherwise promotes
the findings and purpose set forth herein. Any applicant denied a merchant's license
may seek an appeal pursuant to section 9-27. A merchant's license shall be valid based on the dates of issuance and expiration
of the zoning compliance permit issued by the city's zoning department. License fees
shall not be prorated, regardless of the date of issue. The city manager or his designee
may assign the merchant a specific location from which to conduct his business, and
such location shall be specified in the license. Selection of such location shall
be made on a first-come, first-serve basis. A separate license shall be required for
each stand or vehicle used by the merchant.
