§ 7-101. Definitions.

  • The definitions found in section 7-21 of this chapter shall apply in this article. Provided, however, in the event of conflict, the definitions in this article shall prevail. The following words, terms and phrases, when used in this article, shall have the meanings ascribed in this section, except where the context clearly indicates a different meaning:

    Contractor means the person, corporation, partnership, or entity awarded the contract by the multi-family residential facility's authorized management agent which performs cart or dumpster services and/or recyclable materials collection, hauling and delivery.

    Director of public works means the person designated by the city manager to perform duties and responsibilities assigned by this chapter to the director of public works as department head over the public works department.

    Institutional means any establishment engaged in service, including, but not limited to, hospitals, nursing homes, orphanages, churches, schools and universities.

    Multi-family recycling responsible party means the developer, person, firm, corporation, company, management staff, home owner's association, or other group, association, or personnel responsible for providing recycling collection services directly or through a contract hauler and for furnishing and maintenance of containers for solid waste, garbage and refuse disposal for a multi-family residential facility.

    Physical disability means a medical condition, verified by a licensed physician, that makes an individual physically unable to bring the recycling container to the curbside for automated collection and where there is no one else residing in the household capable of taking the containers to the curbside.

    Recyclable processor means a recycling entity selected by the city to accept the recyclable materials collected by contractor under this article.

    Recyclables means items included in local approved recycling programs that includes, but is not limited to, newsprint and accompanying inserts; brown, clear and green glass containers; glass jars; aluminum cans, clean aluminum foil, and clean aluminum food trays; steel and tin cans; empty aerosol cans; plastic bottles and jugs number 1—7; all cardboard that is not wet, waxed or soiled (broken down and placed in container); magazines; office paper; residential mixed paper (office paper, junk mail, catalogs, and paper board such as cereal/food boxes); and other local recyclable processor agreed upon materials.

    Recycling means the process by which recovered materials are collected, separated, processed, and reused as materials for the manufacturing of new consumer products.

    Recycling collection services means the collection and delivery of recyclable materials within the municipal limits of the city.

    Recycling collector means an employee of the city, or a recycling collection agency which operates pursuant to a contract with the city, who collects or transports recyclables.

    Recycling container means a receptacle, including, but not limited to, a cart or dumpster, designed for the purpose of collecting recyclable materials, and designed with an attached lid, handles, wheels if practicable, and sufficient capacity to provide every other week collection of recyclables without overflowing or spilling.

    Recycling fees means the collection fee schedule established by the city from time to time for each occupied dwelling unit or multi-family residential facility recycling responsible party receiving recycling collection services.

    Special collection services means collection services provided for the physically disabled who are unable, because of a disability, hardship, age, or handicap, to roll the container to the curb, may receive additional assistance at no cost, upon approval by the public works director or designee, who may require additional documentation including, but not limited to, a doctor's certification of need for the service provided there is no one else living in the dwelling unit that can push the cart curbside.

    Stationary container means collection container specified and required by city for multi-family residential facilities

    Unit means either a single-family dwelling unit or a multi-family residential dwelling unit as the context requires.

    Unit resident means any owner, lessee, or occupant of a dwelling unit.
