§ 4-40.1. Referral of certain actions to the community improvement commission.

  • (a)

    In the event the inspector issues an order to vacate, remove or demolish a building, and there is no appeal pursuant to section 4-40, the matter shall be submitted within fifteen (15) days thereafter to the planning director or his designee for presentation to the community improvement commission at its next meeting which shall consider, review and evaluate the order and advise city council of its findings by a written report presented to the city clerk no later than thirty (30) days thereafter. The report shall contain a conclusion as to at least the following questions:

    (1)

    Is there a substantive basis for the inspector's order to vacate, remove or demolish the building?

    (2)

    Has the owner been given a reasonable opportunity to bring the building into conformity with the nonresidential building code of the city?

    (3)

    Does the commission recommend additional time for the owner to conduct repairs or improvements necessary to bring the building into conformity and, if so, what period of time is recommended?

    (b)

    The commission shall have the authority to meet with members of city staff, the property owner or such other persons it deems relevant to the matter being considered.
