§ 11-56. Enforcement of provisions.

  • (a)

    Separate penalties. The violation of each section and subsection of this article is a separate violation, subject to a separate penalty. Penalties shall be aggregated for each ordinance section violated for each incident.

    (b)

    Operating an alarm without a permit. Operating an alarm without a permit shall result in a two hundred dollars ($200.00) penalty.

    (c)

    Excessive false alarms. It is hereby found and determined that three (3) or more false alarms within a permit year is excessive, constitutes a public nuisance, and shall be unlawful. Civil penalties for false alarms within a permit year may be assessed against an alarm user as follows:

    Third, fourth and fifth false alarm $50.00 per occurrence
    Sixth and seventh false alarm $100.00 per occurrence
    Eighth and ninth false alarm $250.00 per occurrence
    Tenth and over false alarms $500.00 per occurrence and revocation of alarm permit

     

    (d)

    Other civil penalty(ies). Violations of any other requirement or prohibition of this article shall be enforced through the assessment of civil penalty(ies) in the amount of two hundred dollars ($200.00) for each violation.

    (e)

    Payment of civil penalty(ies). Civil penalty(ies) shall be paid within fifteen (15) days from the date of the notice. Civil penalties not paid within fifteen (15) days from the date of the notice shall incur an additional civil penalty of one hundred dollars ($100.00). A civil penalty, together with any additional penalty, court costs and attorney fees may be recovered by the city in a civil action in the nature of a debt if the violator does not pay the penalty within fifteen (15) days from the date the violator was notified of the penalty. Notification shall be deemed perfected when posted.

    (f)

    Discontinuance of law enforcement response. The failure of an alarm user to make payment of any civil penalty(ies) assessed under this article within fifteen (15) days from the date of the notice shall result in discontinuance of law enforcement response to alarm signals that may occur at the premises described in the alarm user's permit until payment is received.

    (g)

    Civil violation. A violation of any of the provisions of this article shall be a civil violation and shall not constitute a misdemeanor or infraction.
