§ 10-9. Citations issued upon mistake.
(a)
In the event a city traffic or parking violation citation is issued upon a mistake of law or fact, such citation may be voided as provided herein.
(b)
A city traffic or parking violation citation believed to have been issued upon a mistake of law or fact on the part of the issuing officer shall be presented to the chief of police or his designee by the issuing officer or other city police officer.
(c)
The chief of police shall review the law and facts relevant to the issuance of such citation, and, upon a determination, with the concurrence of the city attorney, that the citation should not have been issued, the citation shall be voided and have no further force or effect.
(d)
The chief of police shall retain the voided citation and all copies thereof, together with an explanation of the relevant facts, as part of the city police records.
